About these terms

This website is operated by PolicyScanner (“we”, “us”, “our”). PolicyScanner is a branch partner of Fairstar Insurance Group Inc., an insurance brokerage registered with the Registered Insurance Brokers of Ontario.

By using this site or submitting a quote request, you agree to these terms and to our Privacy Policy. If you do not agree, please do not use the site.

We are a broker, not an insurer

We arrange insurance with insurance companies on your behalf, through Fairstar Insurance Group Inc.. We do not issue policies, carry the risk or pay claims. Whether to offer you coverage, on what terms and at what price, is always the insurer’s decision, based on its own underwriting rules.

General information, not advice

The guides, examples and figures on this site are general information about insurance in Ontario. They are not advice about your situation, they may not reflect the latest changes in law or in insurers’ rules, and they do not describe any particular policy. The wording of the policy an insurer issues to you is what determines your coverage.

For advice about your own insurance, speak with one of our licensed brokers.

Quotes and prices

Any price, saving or rate shown on this site is illustrative. A quote we give you is an estimate based on the information you provide and the insurer’s rates and rules on that day. It is not an offer of insurance and is not binding on us or on any insurer. The final price and terms may change after the insurer verifies your information — for example, your driving record or claims history.

When your coverage starts

Submitting a quote request does not give you insurance. You are covered only when an insurer has accepted your application and you have received written confirmation of coverage from us or the insurer, such as a binder, a pink slip or a policy.

Do not cancel or let lapse any existing insurance until you have that written confirmation for the replacement. Driving without valid auto insurance is an offence in Ontario.

The information you give us must be accurate

Insurers price and issue policies on the information you give. You agree to give us information that is complete, accurate and your own — or that you are authorized to give on behalf of someone else — and to tell us promptly when it changes.

Leaving out or misstating something an insurer would consider important can lead an insurer to refuse a claim, reduce what it pays, or cancel your policy. If you are unsure whether something matters, tell us and we will advise you.

Using the site

You agree not to:

• use the site for anything unlawful, or to submit false information or a quote request in someone else’s name without their permission;
• copy, scrape or harvest content or data from the site by automated means;
• interfere with the site’s security or operation, or try to gain access to parts of it that are not public; or
• use the site to send spam or anything harmful.

We may suspend access to the site, or decline a request, where we reasonably believe these terms have been broken.

How we contact you

When you submit a quote request, you agree that we may contact you by phone, email or text about it, as the consent notice on the form describes. You can withdraw that consent at any time; see our Privacy Policy. If we record a call, for quality or training, we will tell you at the start of the call.

Other websites

The site links to, and uses services from, other organizations — such as insurers, regulators and Google Maps. We do not control them and are not responsible for their content, availability or privacy practices. A link is not an endorsement.

Our content

The content of this site — its text, design, graphics, photographs and the PolicyScanner name and logo — belongs to PolicyScanner or its licensors and is protected by copyright and trademark law. You may view and print pages for your own personal, non-commercial use. Any other use requires our written permission.

Insurers’ names and logos belong to their owners, and are shown only to identify insurers we work with.

The site is provided as is

We work to keep the site accurate and available, but we provide it “as is” and “as available”. To the fullest extent the law allows, we make no promise that the site will be uninterrupted, secure or error-free, or that its content is complete or current, and we may change or withdraw any part of it at any time without notice.

Limitation of liability

To the fullest extent the law allows, PolicyScanner, Fairstar Insurance Group Inc., and their brokers, employees and affiliates are not liable for any indirect, incidental, special or consequential loss, or for any loss of data, profit or opportunity, arising from your use of, or inability to use, this site or its content — including reliance on general information or an illustrative price.

Nothing in these terms limits or excludes any liability or any right you have that cannot be limited or excluded by law, including your rights under Ontario’s Consumer Protection Act. Nothing in these terms reduces the professional duties that our licensed brokers and Fairstar Insurance Group Inc. owe to clients under RIBO’s rules when they give you advice or arrange your insurance.

Indemnity

You agree to compensate PolicyScanner and Fairstar Insurance Group Inc. for any claim, loss or cost, including reasonable legal fees, that results from your breaking these terms or misusing the site, to the extent the law allows.

Changes to these terms

We may change these terms from time to time. The date at the top shows when they last changed. The terms in effect when you use the site are the ones that apply.

Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. You and we agree to the jurisdiction of the courts of Ontario.

If any part of these terms is found to be unenforceable, the rest remains in effect. Our not enforcing a term is not a waiver of it.
